1. Welcome

1.1 Kiwi Transactions Limited (“Waitomo”) has developed the Waitomo app, with its partners,

as a commercial application, to enable customers to make in-app payments at Waitomo

Fuel Stops. All services offered pursuant to the app (“Services”) are provided by Waitomo.

Waitomo is committed to protecting our customers’ personal information. Our Privacy

Policy describes how we collect, use, and disclose personal information, and other analytical

information related to the app, to ensure that we meet our obligations under the Privacy

Act 2020.

1.2 If you choose to use our Services, then you agree to the collection and use of information

in relation to this Privacy Policy. The information that we collect is used for providing and

improving the Services. We will not use or share your information with anyone, except as

described in this Privacy Policy.

1.3 The terms used in this Privacy Policy have the same meanings as in our Terms and

Conditions, which is accessible here, unless otherwise defined in this Privacy Policy.

2. Information collection and use

2.1 For a better experience, while using our Services, we may require you to provide us

with certain personally identifiable information, including but not limited to first name,

last name, mobile number, email address and date of birth.


2.2 The information that we request will be retained by us and used as described in this

Privacy Policy, including for the following purposes:

● Verifying your identity and allowing you to log in and use our Services.

● Providing you with goods and services that you have requested.

● Dealing with your requests, enquiries, complaints, or other customer care-related

activities.

● Occasional marketing of special offers, promotions, or competitions.

● Analysing information in an anonymised aggregated form, such that you will not

be personally identifiable.

● Complying with any legal obligations or any other purpose authorised by you.


2.3 You have the right to request the details of your personal information held by us,

and to request any correction to that information.

Your personal information can be updated by you in the ‘My account’ section of the app. 

Head to the main menu of the app, go to ‘My account’. Simply enter your new mobile number – you’ll then get a verification code sent to your new mobile number to confirm it’s yours. Your Waitomo Moolah balance, and everything else linked to your profile (excluding payment methods which are removed from your profile for security when changing your mobile number), will be transferred to your new number and you’re good to go. 

2.5 You can remove the app from your mobile device at any time by deleting the payment card linked and then deleting the app from your device. You can also delete all account data via the ‘Delete all account data section under ‘My account’ in the app menu. 

2.6 From time to time, we may ask you to provide information about another person to provide app functionality – for example, another person’s mobile number for the purpose of completing a digital Moolah gift or sending a digital app referral on your behalf.

3. Log data

3.1 Whenever you use our Services, in a case of an error in the app, we collect data and information (through third-party products) on your phone called ‘log data’.

3.2 This log data may include information such as your device internet protocol (IP) address,device name, operating system version, the configuration of the app when using our Services, the time and date of your use of the Services, and other statistics.

3.3 Log data may be provided to third-party providers who maintain the app and provide IT services to Waitomo.

4. Other Information - Third-party services

4.1 Waitomo uses third-party analytics and monitoring services to help us understand howthe app is used and to improve its performance and reliability. These services may collect certain technical information about your device and app usage.

4.2 The Services typically collect:

- Device information (type, operating system, app version).

- Usage patterns and feature interactions.

- Performance metrics and crash reports.

- Anonymous identifiers for analytics purposes.

4.3 The collected technical information may be provided to our app designers and providers in order to better provide the Services to you.

5. Service providers

5.1  We may employ third-party companies and individuals for the following reasons:

  • To facilitate our Services;

  • To provide the Services on our behalf;

  • To perform Services-related services; or

  • To assist us in analysing how our Services are used.

5.2  We want to inform users of these Services that these third parties have access to your personal information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

6.1  We value your trust in providing us with your personal information. We strive to comply with the highest commercially acceptable means of protecting your data. But remember that no method of transmission over the internet, or method of electronic storage is 100 percent secure and reliable, and we cannot guarantee its absolute security.

7.1  The Services may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us.

7.2  Therefore, we strongly advise you to review the privacy policies of these websites. We have no control over, and assume no responsibility, for the content, privacy policies, or practices of any third-party sites or services.

8. Children's privacy

8.1  These Services do not address anyone under the age of 18. As we do not collect date of birth details, we do not knowingly collect personally identifiable information from children under 18.

8.2  In the case we discover that a child under 18 has provided us with personal information, we will immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we can complete necessary actions to remedy this.

9. Changes to this Privacy Policy

9.1  We may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
