Official Terms & Conditions

1. Promoter

The promoter is Waitomo Group Limited (“Waitomo”).

2. Promotion Period

The Promotion will take place on 25 February 2025 between 8:30am and 10:30am at the nominated participating Waitomo site only (“Promotion Period”).
Waitomo reserves the right to shorten, extend, reschedule, or cancel the Promotion at its sole discretion.

3. Eligibility

  • Entry is open to individuals aged 18 years or over.

  • Participants must hold a valid and registered Waitomo App account in order to receive any fuel credit.

  • Employees, contractors, and immediate family members of Waitomo or agencies directly associated with the Promotion may be excluded at Waitomo’s discretion.

  • Participation is limited to one performance per person.

Waitomo reserves the right to request valid photo identification and proof of age.

4. How to Participate

  • Participants must attend the participating site during the Promotion Period.

  • Participants must select a song from the official curated list provided onsite.

  • Performances will run between approximately 35 seconds and 1 minute 20 seconds.

  • Participation is voluntary and subject to site capacity, time constraints, and operational safety requirements.

  • Waitomo does not guarantee that all interested individuals will be able to participate.

5. Judging & Prize Determination

  • Performances will be judged by a panel appointed by Waitomo.

  • Each judge will award a score using a paddle system.

  • The total of the judges’ scores will determine the amount of fuel credit awarded.

  • Participants may receive between $8 and $80 in fuel credit, at the judges’ discretion.

  • All judging decisions are final and binding, and no correspondence will be entered into.

Waitomo reserves the right to withhold awarding fuel credit where it reasonably believes a participant has breached these Terms & Conditions.

6. Prize Conditions (Fuel Credit / Moolah)

  • Fuel credit will be loaded directly to the participant’s Waitomo App account.

  • Fuel credit is:

    • Non-transferable

    • Not redeemable for cash

    • Not exchangeable

    • Subject to the Waitomo App Terms of Use

  • Waitomo is not responsible for delays or technical issues outside of its reasonable control, including issues relating to mobile devices, internet connectivity, or third-party systems.

  • Any unused fuel credit remains subject to standard Waitomo App expiry terms.

7. Health & Safety

This Promotion takes place in a live fuel retail environment.

Participants agree that:

  • They will comply with all onsite safety instructions at all times.

  • They will wear high-visibility clothing where required.

  • They will not obstruct fuel pumps, vehicle access, pedestrian areas, or operational zones.

  • They will not approach customers actively refuelling.

  • They will follow all directions from Waitomo staff and event personnel.

Waitomo reserves the right to immediately remove or refuse participation to any individual who:

  • Acts in a manner that is unsafe, disruptive, intoxicated, aggressive, or inappropriate.

  • Fails to follow safety instructions.

  • Poses a risk to themselves, staff, or other customers.

Participation is at the individual’s own risk to the fullest extent permitted by law.

8. Conduct & Content

  • Performances must be suitable for a public, family-friendly retail environment.

  • Offensive, defamatory, discriminatory, or inappropriate behaviour or language will result in immediate disqualification.

  • Song lyrics must not be altered to include inappropriate content.

Waitomo reserves the right to stop any performance at its discretion.

9. Filming & Media Consent

This is a filmed and photographed event.

By participating, entrants:

  • Consent to being filmed, photographed, and recorded.

  • Grant Waitomo (and its media and promotional partners) a perpetual, worldwide, royalty-free licence to use, reproduce, edit, publish, and distribute their image, voice, name, and performance for promotional, marketing, publicity, and social media purposes, in any media now known or developed in the future.

  • Acknowledge that no additional compensation will be provided for such use.

Participants may be required to complete a written media consent form prior to performing.

10. Liability

To the maximum extent permitted by law:

  • Waitomo and its related entities, employees, contractors, and agents exclude all liability for any loss, damage, injury, or claim arising directly or indirectly from participation in the Promotion.

  • Waitomo is not responsible for any personal property lost, stolen, or damaged during the event.

  • Nothing in these Terms & Conditions limits or excludes rights under the Consumer Guarantees Act 1993 where applicable.

11. Force Majeure

Waitomo is not responsible for cancellation, delay, or disruption caused by events beyond its reasonable control, including but not limited to weather events, technical failures, site incidents, or regulatory direction.

12. General

  • Waitomo reserves the right to verify the validity of participants and to disqualify any individual who tampers with the entry process or breaches these Terms & Conditions.

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

  • These Terms & Conditions are governed by the laws of New Zealand.

By participating in the Promotion, entrants confirm that they have read, understood, and agree to these Terms & Conditions.
